A portion of the Higher Education Opportunity Act that was signed into law by President Bush on August 14, 2008 went into effect on July 1, 2009. This allows active duty members in the armed forces and their spouses or dependent children to receive in-state tuition if they have been stationed in a state for more than 30 days. It also allows the individual to keep the in-state tuition rates as long as they are continuously enrolled in that institution of higher learning, even if the service member is reassigned outside the state.
